Expungement and sealing are two separate things in Illinois. You may be eligible for expungement if you were only arrested, charged, but never convicted of a crime, or violated a municipal ordinance.
In addition, as of January 1, 2020, Illinois now automatically expunges arrest records of individuals who have been convicted of possessing 30 grams or less of marijuana, if one year has passed since their arrest and the violation did not involve a minor or a violent crime.
On the other hand, you may be eligible for record sealing if you have been convicted of most misdemeanors and certain felonies. Some convictions require a person to wait two or three years after completing their sentence before they can get their record sealed.
Keep in mind, if you have been convicted of a sex crime, domestic battery, an animal care crime, or DUI, you cannot have your conviction expunged. Furthermore, individuals who are required to register under the Murderer and Violent Offender Against Youth Registration Act, Sex Offender Registration Act, or the Arsonist Registration Act are not eligible for record sealing.
